1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of cinthiasouccarkorkhova.com (the “Site”) and any purchase of works from Cinthia Souccar Korkhova (“CSK,” “we,” “us,” or “our”). By using the Site, submitting an inquiry, or placing an order, you agree to these Terms.

2. The Works

Each piece is handmade and one of a kind. Natural variations in form, colour, glaze, texture, and finish are inherent to handmade ceramics and are not defects. Images on the Site are representative; the piece you receive may differ slightly in appearance.

3. Inquiries, Orders, and Pricing

Works are offered through inquiry. Prices are listed in euros (EUR) and are exclusive of any shipping, duties, or taxes unless stated otherwise. We reserve the right to correct errors, update pricing, and decline or cancel any order at our discretion.

4. Payment

Payment is due in full before an order is dispatched, unless otherwise agreed in writing. Title to a piece passes to you only once payment has been received in full.

5. All Sales Are Final

All sales are final. We do not accept returns, exchanges, or cancellations, and no refunds are issued, except where required by applicable law or as expressly set out in Section 6 below. Because each piece is unique and handmade, please consider your purchase carefully and contact us with any questions before buying.

6. Delivery, Inspection, and Damage Claims

You must inspect your piece in the presence of the delivery person at the moment of delivery, before signing for or accepting it. If a piece arrives broken, cracked, chipped, or otherwise damaged, the damage must be documented on the spot, at the time of delivery, and the documentation must include all of the following:

• clear photographs of the damage and of the packaging, taken at the point of delivery;
• the date and time of delivery (timestamps);
• a written note acknowledging the damage, signed or confirmed by the delivery person; and
• immediate notification to us at info@cinthiasouccarkorkhova.com, with the above documentation attached.

If the damage is not documented on the spot at the time of delivery and communicated to us in this manner, no refund, replacement, or credit will be issued. Claims for damage reported after the piece has been accepted, unwrapped at a later time, or submitted without the required photographs, timestamps, and delivery-person acknowledgement cannot be honoured.

7. Risk of Loss

Risk of loss or damage passes to you upon delivery. It is your responsibility to inspect and document the condition of the piece at the time of delivery as set out in Section 6.

8. Intellectual Property

All content on the Site — including images, text, designs, and the works themselves — is the property of CSK and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without our prior written permission.

9. Disclaimer of Warranties

The Site and the works are provided “as is.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose, except for any non-excludable rights you may have under applicable law.

10. Limitation of Liability

To the fullest extent permitted by law, CSK shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or any purchase. Our total liability for any claim shall not exceed the amount you paid for the piece giving rise to the claim.

11. Governing Law

These Terms are governed by the laws of France, without regard to conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of the competent courts of France, subject to any mandatory consumer protections available to you.

12. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision, and your continued use of the Site constitutes acceptance of the updated Terms.
